A lawyer is set to face court charges for allegedly committing forgery to acquire 59 million shillings.

A Nairobi court has postponed the plea hearing for city lawyer Nelson Ndalila, who is facing allegations of document forgery and fraudulently obtaining Ksh 59,000,000. Ndalila did not appear in court on Friday before Milimani magistrate Dolphina Alego, who has now ordered him to appear on Tuesday, May 5th.

Lawyer Andrew Muge, representing the complainant, opposed the accused’s attorney’s request to postpone the plea on medical grounds. Muge stated, “The accused was arrested yesterday (Thursday) and was expected in court today; his absence is a clear indication of delaying tactics.” The accused, Ndalila, faces four charges, including forgery, and is currently out on a police cash bail of Ksh 50,000.

The primary allegation asserts that on June 2, 2023, at an undisclosed location within Kenya, Ndalila, in collaboration with others not present in court, created a fraudulent document—a trust deed for the Better Life Family Trust—claiming it to be legitimate concerning the estate of the late David Jonathan Grantham, which they knew to be false. Additionally, the fourth count alleges that on the same date and location, Ndalila and accomplices forged a trust deed for the Better Life Family Trust to unlawfully obtain Ksh 59,000,000 from Grantham’s estate.
