The Aftermath of Richard Kerich’s Fraud Case: What’s Next for the Former NHIF Boss?

The court determined that the prosecution was unable to substantiate its case, which has been ongoing for several years. Kerich, along with four other individuals and a medical center, faced charges related to the misappropriation of millions from a medical scheme for civil servants and disciplined forces.

The co-defendants included Marwa Chacha, David Kipruto Chingi, Peter Ngunjiri Wambugu, and Ndiba Wairioko. After nearly a decade of legal proceedings, Kerich and his co-accused were acquitted. The prosecution contended that the officials had knowingly engaged with a third party that was incapable of delivering the necessary services for the agency.

The individuals faced allegations of abuse of office related to offenses purportedly committed between 2011 and 2012. The prosecution claimed that the private medical center awarded the tender by the national insurer failed to fulfill its obligations. In response, Kerich and his co-defendants refuted the conspiracy to defraud charges, asserting that their actions were lawful.

Initially, in 2017, a court dismissed the case, with Senior Principal Magistrate Martha determining that the prosecution had not presented sufficient evidence, particularly lacking an audit report. Nevertheless, the Director of Public Prosecutions later sought new orders, leading to a 2021 court ruling that reinstated the case against the suspects, indicating they had a case to answer.
